FIREMAN'S INJURIES.

Davenport v Metropolitan Transport Trust.

Damages of £2000 were claimed by Raymond Davenport, a ship's fireman, from the Metropolitan Transport Trust for personal injuries received by the plaintiff as the result of negligence said to have been shown by the defendant's servants in the management of a tram.

Plaintiff gave evidence that on the afternoon of September 19, 1929, he joined an outward-bound Bellevue tramcar and took a seat in an open smoking compartment with his back to the driver. As the tramcar left the Liverpool-Bourke streets stopping place the tram gave such a jolt that he was thrown forward, and, being unable to grasp any of the handrails, fell out of the tramcar and was bumped and run over by a tramcar travelling in the opposite direction. He received injuries resulting in the amputation of both legs.

Defendants denied liability or responsibility for the accident, and set up that the tramcar started off slowly from the recognised stopping-place and jolted as if it had struck a stone or some other obstruction.

The action is part heard.

Mr. H. G. Edwards (instructed by Messrs. Sullivan Brothers) appeared for plaintiff; and Mr. Lamb, K.C., and Mr. W. J. Bradley (instructed by the Solicitor for Railways, Mr. Brctnall) for defendant.
