Forrest I George Forrest Brewer in Hamilton in order to regulate
the management of my means and Estate after my decease do hereby
dispone Assign Convey and make over to William Rankine China
Merchant in Hamilton John Christie Writer Hamilton, & Ord Adams
Coalmaster Aronbridge near Hamilton, and to Such other person or
persons as I shall hereafter name, or as shall be assumed in Virtue
of the powers afterwritten to act in the Trust hereby created & to
the acceptors or acceptor and Survivors & last survivor of the per-
sons hereby named or to be named or assumed as aforesaid as
Trustee for Executing the Trust hereby created_ The Majority of the
said Trustees whilst more than two accepting are alive & acting as
Trustees being always a quorum whom all failing then to the nearest
heir male of the last accepting and surviving Trustee who shall be
major at the time (the said Trustees named & to be named & assumed
and their foresaids being throughout these presents denominated "my
Trustees") & the assignees of my Trustees heritably and irredeemably
All & Sundry lands and heritable Estate of Whatever kind as also
my whole moveable & personal means & Estate of whatever kind
which shall belong to me at the time of my death, And I appoint
my Trustees my sole Executors And I oblige myself and my heirs
and Successors to Infeft my Trustees in due and competent form
And to grant all deeds necessary for that purpose: And I assign
the Writs Evidents and Title Deeds of my heritable Estate; But
Declaring that these presents are granted only in Trust for the fol-
lowing uses and purposes, First my Trustees shall from the
produce of my means and Estate pay all my past lawful
debts & funeral Expenses, And the Expense of Executing this trust
Second my trustees shall also pay all such legacies, gifts or
provisions and implement all such instructions as shall be con-
tained in any codicil or any memorandum or writing by me
Clearly Expressive of my Will though not formerly Executed
Declaring that the same whether formal or informal shall be held
& taken to be part and parcel of these presents: And Third I direct
& Appoint my Trustees on the Expiry of six months from the
period of my decease or as soon thereafter as to them shall seem
Expedient for the love, favor and Affection I bear, and for other
good causes and considerations to dispose, convey, and make
over the whole remainder and residue of my Estate generally
above disponed or of the prices and produce thereof to and in
favor of Miss Helen Smith my cousin presently residing with
me And the whole rights and securities thereof rested in my trustees
to be used & disposed of by the said Miss Helen Smith according
to her own free will and pleasure, But Expressly excluding the
Jus Mariti or right of administration of any husband whom
the said Miss Helen Smith May Marry, And I direct my
Trustees to insert a clause in conformity herewith in any
Conveyance Conceived by them in Virtue hereof in her favor
With power to my Trustees to appoint either one of their own
Number or any other person either with or without caution
to be their factor or agent or cashier, for uplifting discharging
& conveying the funds of the Trust hereby created & the securities
held by them for the same & for Applying the same to the
purposes of the said Trust; And to give reasonable allowance to such
factor agent or cashier for his trouble, And is also with power of
sale by Public or private bargain & of compromise or submission
And in general to do or cause to be done every thing necessary for
the Execution of the trust hereby created, and for these purposes to
grant, subscribe and deliver all writs and deeds requisite &
necessary. And I hereby declare that my Trustees shall nowise be
liable for nay omissions in management nor for the omission
& neglect of their factors agents or cashiers, nor for the respon-
sibility of them or their cautioners if caution shall be required or
for the responsibility of the debtors, purchasers, or others with
whom my Trustees may transact, but that they shall only be
bound to act honourably, and shall nowise be liable singuli
in Solidum or for one another, but each for himself only &
for his own personal intromissions or wilful Default & no further
And my Trustees are hereby empowered from time to time nom-
inate and appoint any person or persons to be a Trustee or
Trustees along with them or in place of any Trustee or Trustees who
shall die or deserve to be discharged or refuse decline or become in-
capable to act in this trust And when and so often as any new
Trustee or Trustees shall be so nominated & appointed all the
Trust Estates & effects heritable & moveable real and personal
shall forthwith be disponed & assigned in such form as that
the same shall be Vested in such new Trustee or Trustees jointly
the continuing Trustee or Trustees or soley<<?>> in the new Trustee or
Trustees in case of their being no Continuing Trustee & that for the
purposes of this Trust & no otherwise & I reserve full power to
Revoke these presents in whole or in part And I dispense with the
delivery hereof, And I consent to the Registration hereof and of any
codicils or additions hereto for preservation : In Witness Whereof I
have subscribed these presents written upon this and the two
preceding pages of Stamped paper by Robert Bell apprentice to
the said John Christie Writer in Hamilton at Hamilton the
the 16th day of December, 1853 before these Witnesses Robert Bell

John Christie, It being declared that the letter "l" on the second
and the word "any" on the twenty second lines from the top of page

Codicil (follows Codicil) I George Forrest Brewer of Hamilton Con-
sidering That by the foregoing General Trust Disposition and
deed of Settlement executed by me on the 16th day of December
1853 I disponed Assigned Conveyed & made over to William
Rankine China Merchant in Hamilton, John Christie writer
Hamilton and Ord Adams Coal Master at Avonbridge near
Hamilton and to such other person or persons as I should thereafter
name or as should be assumed in Virtue of the powers therein
written to act as Trustees and Executors in the Trust thereof Crea-
ted And by which Deed I reserved full power to Revoke
the same in whole or in part Therefor I do hereby Recall and
revoke the Nomination & Appointment of the said William
Rankin as one of my said Trustees and Executors and Dis-
charge him of said offices Accordingly And I do further
hereby Nominate & Appoint Peter Watson Dickson Accountant
residing in Tuppall as a Trustee and Executor along with the
saids John Christie & Ord Adams under said General Trust
Disposition And Deed of Settlement with the whole powers privileges
and faculties conferred on my said Trustees & Executors under
the foresaid Deed: Declaring Always that these presents shall
noways infer a revocation of my said General Trust Dispos-
ition & Deed of Settlement but that the same shall stand
in full force with this addition thereto. And I Consent to
the Registration hereof in the Books of Council & Session or others
Competent therein to remain for preservation & to that effect
Constitute the said John Christie my Procurator. In Witness

Inventory of the personal estate of George Forrest Brewer in
Hamilton who died at number 36 Quarry Street there Testate on the
9th day of June 1855.

In Presence of James Veitch Esquire Advocate Commissary Depute of
Lanarkshire Compeared John Christie Writer in Hamilton who being
solemnly sworn and examined Depones That the said George Forrest
died upon the 9th day of June 1855 and the Deponent has entered
upon the possession and management of the deceaseds personal
Estate as the only accepting Executor nominated by him in a General
Trust Disposition and Deed of Settlement executed by the deceased upon
the 16th day of December 1853 and Codicil thereto dated upon 22d day
of January 1855 and registered in the Sheriff Court Books of Lanarkshire
at Hamilton upon the 18th day of February 1856 and Extract whereof
is now exhibited and signed by the Deponent and the said Commissary
Depute of this date as relative hereto : That the Deponent does not know of
any Settlement or Writing relative to the disposal of the deceased's personal
estate or effects or any part of them other than that now exhibited : That
the foregoing Inventory which is signed by the Deponent and the said
Commissary Depute as relative hereto is a full and true Inventory of all
the personal or moveable estate and effects of the said deceased George
Forrest wheresoever situated, already recovered or known to be existing
belonging or due to him beneficially at the time of his death, and that
the said estate situated in Scotland is of the Value of L20 and under
the Value of L50 All which is truth as the Deponent shall answer
